Terms of service
Last updated: 25 October 2026
This document is a standard template prepared for The Imaginations. It is to be reviewed by the owner (and, ideally, a legal adviser) before it is relied on.
These terms govern your use of AirTikal — the digital news articles service and the digital magazine service (together, the “Services”) — and this website, provided by The Imaginations, a proprietorship based in Surat, Gujarat, India (“we”, “us”). By creating an account, paying for a package or using the Services you (“the Client”) agree to these terms.
1. The Services
AirTikal supplies original, machine-assisted and edited news articles and digital magazines in the categories the Client selects, and delivers them to a white-label website operated by us on the Client’s domain, to the Client’s own content-management system (CMS), or through an API. Features, categories and delivery methods may be improved or changed from time to time; we will not materially reduce a paid package during its current period.
2. Accounts and team logins
- The Client must give accurate business and contact details and keep them up to date.
- The Client is responsible for its users’ logins and for everything done through them. Tell us at once of any unauthorised use.
- We may suspend an account that is used unlawfully, that puts the Services at risk, or that is unpaid.
3. Packages, wallet and payment
- Monthly news package. A package is paid in advance for a monthly period and includes a stated number of articles (English or Indian-language). Unused articles lapse at the end of the period and are not carried forward or refunded.
- Prepaid wallet. Packages, magazine issues (charged per issue), extra-news packs (100 articles per pack, bought once the package is used up), translations and the yearly white-label website are paid from the Client’s prepaid wallet at the published prices. When the package and the wallet are both used up, delivery pauses until the Client renews or tops up.
- When an article counts. An article is counted when it is delivered — published on the Client’s white-label site or accepted by the Client’s CMS. Articles held by a category cap, or not delivered, are not charged.
- Renewal. If auto-renew is on and the wallet covers the package price, the package renews automatically for the next period. The Client can switch auto-renew off at any time before renewal.
- Prices and tax. Prices are in Indian rupees. GST not applicable: The Imaginations is a proprietorship not registered under GST (aggregate turnover below the threshold). If we become GST-registered, GST will be added as required by law and shown on invoices.
- Invoices. We issue an invoice for every purchase and a receipt for every wallet top-up.
- Refunds and cancellations are governed by our Refund & cancellation policy.
4. Content and licence
- On delivery and payment, the Client receives a non-exclusive, perpetual, worldwide licence to publish, edit and archive the delivered articles and magazine issues on its own channels. We do not deliver the same article to another client.
- Articles are prepared from publicly available information and are rewritten in original wording. The Client remains the publisher of what it publishes, may edit any article, and can choose to receive articles as drafts for review.
- While we take care to verify facts, news can change quickly. Articles are provided “as is”; the Client should review sensitive content (for example legal, medical or financial matters) before publishing and should not treat articles as professional advice.
- Content the Client adds itself (its own articles, profile pages, logos) remains the Client’s. The Client confirms it has the rights to it and that it is lawful.
- Website designs, software and the AirTikal name and branding remain ours.
5. Acceptable use
The Client must not use the Services to publish unlawful, defamatory, obscene or infringing content, to mislead readers, to send spam, or to attack, overload or reverse-engineer the Services. The Client is responsible for complying with laws that apply to its publication, including the Information Technology Act, 2000 and rules made under it.
6. Domains and white-label sites
For a white-label site the Client points its domain’s DNS to us; we set up hosting and a TLS certificate. The Client keeps ownership of its domain and is responsible for renewing it. If an account ends, we stop serving the site on that domain.
7. Records and audit
We keep a record of every delivery (to whom, when, how and at what charge) and of where each story originated, so that disputes can be resolved. Our records are the basis for usage and charges unless shown to be wrong.
8. Availability and liability
- We aim for continuous service but do not guarantee that the Services will be uninterrupted or error-free. Planned maintenance will be kept short.
- To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue or reputation. Our total liability for any claim is limited to the amount the Client paid us in the three months before the claim.
- The Client indemnifies us against claims arising from content the Client publishes or edits, or from breach of these terms.
9. Ending the agreement
The Client may stop at any time by switching off auto-renew; the current paid period runs to its end. We may end or suspend the Services for serious or repeated breach, non-payment, or if required by law, with notice where reasonable.
10. Changes
We may update these terms. Material changes will be notified by email or in the console at least 15 days before they take effect; continued use after that means acceptance.
11. Governing law and disputes
These terms are governed by the laws of India. The parties will first try to settle any dispute in good faith. Subject to that, the courts at Surat, Gujarat have exclusive jurisdiction.
